One of the primary function of Strategic Management is to serve as a cap-stone course integrating the material students have accumulated throughout their course of study within a business school.There is a need for instruments that will provide the necessary integration and opportunity for application of acquired knowledge. There is also the reality that students do not remember all that they should from previous courses. Equally important is the necessity to impart the basics of Strategic Management as a discipline in its own right. It is the theoretical foundation of Strategic Manage ment that provides the rational for the integration. The purpose of this article is to provide an outline for analysis of a firm. I use this method at both the undergraduate and graduate levels.The only difference is that graduate students are expected to show more sophistication in their presentations. Strategic Management Case Analysis Firm Analysis This is the second of a two part series dealing with one approach to case analysis in Strategic Management classes. This paper takes the view that Strategic Management is a cap-stone course intended to integrate the material students have accumulated throughout their course of study within a business school. Strategic Management is, in fact, the only course that has as its stated purpose the integration and application of key management concepts.Normally, students are expected to have a working knowledge of the primary business management disciplines of accounting, economics, finance, marketing, and operations, when entering the course . When instructors present case analysis, it is usually as a three-step process progressing from economic, to industry, and finally, to company analysis. In doing so they face the challenge of creating a classroom experience that enables students to conceptualize the framework as an integrated whole. The challenges for the instructor are interesting to say the least.First, there is the need for the instructor to understand the intent of each of the primary business management disciplines, as well as what the student can be expected to accomplish. Second, there is the need for instruments that will provide the necessary integration and opportunity for application of acquired knowledge. Third, there is the reality that students do not always remember all that they should. This leaves a great deal to be accomplished within one semester. An equally important challenge is the necessity to impart the basics of Strategic Management as a discipline in its own right.It is the theoretical fou ndation of Strategic Management that provides the rational for the integration. More importantly, the students needs an understanding of ‘when’ to use ‘what’ techniques in the business world. Given these challenges, I use – among other classroom techniques – case analysis. Students are required to provide analysis and discussion for a number of short cases throughout the semester. All are taken from current publications such as, Business Week, Fortune, Forbes and The Economist. I find that text book cases do not provide the currency necessary.These cases are used to demonstrate the text theory under discussion, and to show the relevance of specific elements of the major written cases. I require two major written cases. The first is an analysis of an industry, and the second is an analysis of a firm within that industry. Both are essential to achieve the learning objectives for the course. The learning objective for the course is: to understand how the top manager (CEO) is responsible for ensuring the long term survival of the firm within its competitive environment.The learning objective for the written case analyses is: to arrive at a point where they can develop a sound business plan to ensure the survival of their chosen firm within its competitive environment. Also, to appreciate the complexities of collecting and understanding the relevance of the vast amount of information available. The learning objective for the industry analysis is: to determine the opportunities and threats that exist for firms within a competitive environment. They should be able to appreciate how the various forces operating in an industry create or limit the chances for survival.The learning objective for the firm analysis is: to determine the strengths and weaknesses of a firm; and, to determine the core competence that can be built on to establish a competitive advantage. The final step is to develop a business plan that will align the cap abilities of the firm with the requirements of the competitive environment. Students are required to work in teams to complete the two major case write-ups. They will later make a presentation of their findings. I require teams because the most difficult part of management is the management of human resources.By setting specific guidelines for students I make their grade contingent on their management abilities as well as their ability to complete the projects. Team size is limited to 3 or 4 members. They are free to choose their firm and its industry. I strongly suggest that they select a firm that has a production function. This makes it easier to see the four organizational functions being integrated. I also encourage them to select an industry that would be suitable for employment based on their particular interests, and primary area of concentration.For example, accounting majors are encouraged to examine an accounting firm. Finance majors are pointed toward the banking industr y. In the end, the students make choices based on group consensus and personal interests. However, a mixture of majors can be an advantage when working on the papers. The possible collaboration and integration of different perspectives is one advantage; another is the opportunity to work on a part of the papers that is relevant to their discipline. How firm’s performance is defined is left to the student. I must approve all choices prior to the student beginning work.In this way, I am sure that the projects are do-able. No two groups are allowed to do the same firm within the same class, but they can do different firms within the same industry. There are no ‘easy’ industries or firms. Each has its own challenges. A significant amount of time is spent covering analysis techniques, and the resources available, prior to the students starting on the projects. They are also encouraged to divide the work up into specific areas. For example, for the firm paper: do the f our functional areas first, then do the introduction and conclusion.This gives a reasonable balance to the work load. One common complaint about this approach to case writing is that a student working on one section of the paper will not learn about the other sections of the paper. Every approach to case writing has a limitation, but I think that this one is manageable. First, the intent is not to teach students about one particular industry. It is to teach them the relevance, and the techniques, of industry and firm analysis. Stressing this point early on is very important. It is important to note that I do not give the students too many specific directions.I want them to do their own research and make discoveries along the way. There is no one right answer. Correctness – if such exists – is a product of the logic used in the analysis. For example, two measures of economies of scale are required. It does not matter which measures are used, what matters is that the stu dent reasons through the problem and finds a means of justifying a position. If I give too much detail it limits the imagination of the student and prevents discoveries that could be significant. To help get the students oriented, I do provide complete ‘sample’ papers from a previous class.I am careful to ensure that the sample papers are on an industry and firm not currently being done. I do not have to worry about copying, or other forms of cheating. The papers must be up-to-date, which means significant recent citations in the bibliography. Additionally, I do provide the students with the opportunity of sending in parts of the project as they write. I then provide feedback to prevent them going off on tangents and wasting valuable time. Most students find this method beneficial as they work. I find the quality of the papers improves dramatically over the course of the semester.It is critical to stress that this is a business report, and not an English paper. Each pap er will take on significant proportions (30 to 50 pages) if just the required work is done. If focus is not maintained, the size becomes unmanageable. Assumptions and common knowledge are not accepted. Everything has to be proven in some manner, if just by an interview with a business person. Quantitative and qualitative analysis are required. I give a number of examples in class of how wrong ‘common knowledge’ can be. The firm paper analysis that follows has been adapted from the work of Wheelen & Hunger (2000)[1].Their model for the evaluation of firms has been evolving for over a decade, and represents one of the more concise approaches to firm analysis. This approach is compatible with a number of Strategic Management text and can easily be adapted to most situations. In addition, my own experiences in the business world have been incorporated. In what follows, I cover in some detail the outline for the firm paper. This outline is given to the students in its entire ty. FIRM PAPER OUTLINE This outline is only a guide. Each firm is unique, and you are responsible for adapting your paper to fit the circumstance.Form is important, but must not replace reason. Learning Objective: to determine the strengths and weaknesses of a firm; and, to determine the core competence that can be built on to establish a competitive advantage. Method: Firm analysis and the development of an abbreviated business plan to ensure long term survival within the competitive environment. Compare your firm to a better performing firm within the same industry, or to the industry trends that you created in the industry paper. Maintain your focus on the questions being asked. Provide conclusions for each section and sub-section.A decision matrix should be provided at the end of each section, and an overall matrix provided in the conclusion section. Where quantitative analysis is required, provide numbers expressed as ratios. Use five years of data to establish trends. Where qu alitative analysis is required, provide citations to support your arguments. Assumptions and common knowledge are not accepted. Continuity: I do read these papers! Be sure that if you make a declarative statement in one section, you do not contradict yourself in another. While it is a team project, I read it as the work of one person. Integrate the paper.Please number pages, and use section headings and sub-headings. Help is just a mouse-click away! I strongly encourage you to show me your work as you progress. I can, and will, save you hours of frustration if you will show me what you are doing. I. Current Situation A. Brief firm history. What industries and industry segments is your firm involved in, and what will be the focus of the paper? You can not do all of the industries or segments in one semester. Make a rational choice that aligns the firm paper with the industry paper. Provide a statement of the current position or situation of your firm within the industry (i. e. how go es it). How diversified is this firm? Related or unrelated (you may discuss this wherever you think most appropriate)? B. Strategic Posture. 1. What is the current mission? Did you have to deduce it, or was it stated. Is there a clear point B (an objective that we can quantify)? You should be concerned with both the quality of the mission statement, and its appropriateness for the competitive environment. You will be able to address this issue after you complete the firm analysis. 2. What is the current (Porter’s generic) strategy? Since you are only doing one segment, you are concerned with business-level strategy only.Is this strategy consistent with the mission, appropriate for the environmental context, being followed by management? Again, this is best answered after the analysis is complete. II. External Environment (Opportunities and Threats. ) This section is a restatement of some of your industry paper work. You restate your findings with respect to this specific firm . A. Socio-cultural. What general environmental factors among the socio-cultural, economic, political-legal, and technological forces are currently affecting both the firm and the industry in which it competes?Which present, current, or future threats or opportunities are important to your firm? B. Task Environment. Which of the five forces (Porter’s) in the immediate environment are currently affecting the level of competitive intensity within the industry? Which present current or future threats or opportunities important to your firm? III. Internal Environment (Strengths and Weaknesses) The only way to know if your firm is doing well is through comparison. Therefore, almost all of the elements that follow require the analysis of your firm and then a comparison to a better performing firm, or to industry standards.A. Management. The objective of the management function is to ensure the long-term survival of the firm within its competitive environment. Begin with your assess ment of how management has addressed this objective. 1. Board of Directors. The objective of the board is to provide oversight of the firm. Based on your observations is this board appropriate for the competitive environment of this organization? a. What is the board size and composition (averages for all firms is 74% external, with 14 members total). b. What are their skills? Do you have the four functional areas covered? c.Do they own a significant percentage of stock? Here you are testing elements of agency theory. d. What is their level of involvement in the oversight of the corporation? That is, what committees are they on? How often do they meet? 2. Top Management (usually only the CEO). The objective of management is to ensure the survival of the organization within its environment. Is management achieving that objective? a. What are top management's chief characteristics in terms of knowledge, skills, background, and management style? Is top management sufficiently skilled t o cope with likely future challenges?Has it established a systematic approach to the formulation, implementation, evaluation and control of strategic management? Is there a vision, clearly articulated, guiding corporate activities (i. e. , does this manager know where the organization is headed)? What is the degree of stock ownership, and is it appropriate? b. Organizational Structure. What is the present structure? Discuss decision making authority, degree of autonomy, team building, empowerment, etc. Is the structure appropriate for the competitive environment and consistent with the current strategy and mission? c. Culture.Is there a well defined or emerging culture composed of shared beliefs, expectations, and values? Is the culture a source of support or hindrance to achieving the mission/strategy of the corporation? B. Marketing The objective of the marketing function is to maximize market share. Are they achieving this objective? You should be able to provide a graph of marke t share change over time compared to another firm or the industry. What is the market share change of the firm in relation to market growth? Remember to use ratios, not raw numbers. How well is the corporation performing in terms of market position and marketing mix?You answer this by comparing the 4 P's to a better performing firm. 1. How well does your firm's product offering (product mix) compare to a better performing firm? 2. Is the firm's pricing appropriate? 3. Compare the place (distribution system) of the product offering. 4. Evaluate the promotional efforts of the firm. What is the payoff for the money spend on advertising? Is there a relationship between advertising and market share change? Provide a conclusion to this section. What trends do you see from analysis of their past performance? I suggest using a decision matrix.From your analysis, what are the strengths and weaknesses of this function? C. Operations/Production. This section will be revised for those teams doi ng a service firm. While the basic arguments are the same, the methods will be different. Consult with your instructor before beginning this section if you are doing a service organization. The objective of the operations function is to increase productivity. Are they achieving this objective? This is also the functional area where you can best evaluate whether your firm is following the logic of re-investing in itself (the logic of the managerial enterprise)? 1.In order to achieve improvements in productivity, the firm must be re-investing in itself. What is the trend in capital spending? What is the trend in productivity improvement? 2. In combination with the marketing section, has this firms emphasized product development, or diversification, for growth (the Chandler argument)? No longer required. 3. Operating leverage. How has the mix of people to capital changed over time – are fixed costs rising? What are the trends in costs per unit of labor, inventory control, etc.? 4. Research & Development. What return is the corporation receiving from its R&D investment?Is the firm technologically competent? How well does the firm's investment compare with similar corporations? What is the bang for the buck! Provide a conclusion to this section. I suggest using a decision matrix. From your analysis, what are the strengths and weaknesses of this function? D. Finance The objective of the finance function is to maximize shareholder wealth. Are they achieving this objective? I would prefer total returns to investors over time as the measure here. The data are available. 1. Remember to use at least five years of data for the most important factors. What trends do you see emerging from this analysis?Suggested ratios are contained in the text. 2. How well is the corporation performing compared to competition? 3. Capital Asset Pricing Model. (Class lecture notes) What is the cost of capital for this firm? What impact does this have on competitiveness? What does your analysis tell you about the probability that management will reinvest in the firm? 4. Debt to Equity policy and susceptibility to external forces, such as debt covenants, take-over attempts, etc. As lecture material points out, the capital structure decision is very important to the survival of the firm. Crunching of numbers is not the objective here.You are looking for significant trends that can impact the survivability of the firm. As you find negative trends that could effect other organizational functions, tell your team mates. What have they discovered? This section can not stand on its own, it has to be integrated into the overall paper. Provide a conclusion to this section. I suggest using a decision matrix. From your analysis, what are the strengths and weaknesses of this function? E. Human Resource Management. If applicable – i. e. , are unions involved? If so, you are concerned with the HRM function of the organization. F. Management Information Systems.If applica ble. Is you firm having problems with its MIS system? Readings from articles should give a clue. If no problem is noted, you do not have to include this section. IV. Critical Success Factors. From your industry paper, discuss how your firm is addressing these factors. Most of these factors (2 of 3) will lend themselves to quantitative analysis and comparison. V. Strategic Problem. From your analysis, what is THE strategic problem of this firm. This is only one paragraph and not a laundry list. Clue – your paragraph will begin: Management has failed to ensure the long-term survival of this firm because†¦.. VI.Strategic Alternatives. Provide appropriate strategic alternatives stated as strategies, not as elements of a strategy. Discuss the pro's and con's of each. The current strategy, if appropriate, could be one of the alternatives if the firm simply needs to improve the implementation of that strategy. VII. Recommendation. From your alternatives, what ONE strategy do yo u recommend, and why? This is only one or two paragraphs. VIII. Implementation. This is the section where most teams lose it. Remember that strategy is a pattern of actions and activities. A. Give SPECIFIC recommendations on how you would implement your strategic choice.Provide details addressing each of the four functional areas. B. Show how you are solving the weaknesses and building on the strengths of each functional area. C. What is the core competence of this organization? Can we build a sustainable competitive advantage within this industry? D. Include a basic pro forma for at least 5 years out to see the impact of your changes. Use your best guess on the numbers, indicating your assumptions. E. Conclude the paper with your prognosis for the firm. Mycobacterium Tuberculosis Evolved in Response to Antibiotic

How have Mycobacterium tuberculosis evolved in response to antibiotic use? Section 1 P1: (Words: 177) Since antibiotics has been discovered in 1920 by a Scottish microbiologist Alexander Fleming, people began to have access to treatments for infectious diseases (Bright). However, over time these M. tuberculosis has evolved and became resistant to antibiotics through constant use and incorrect usage (Bright). It is important to solve this health issue because it has created a serious problem to the people who are infected by diseases since these antibiotics are no longer effective.It is estimated that approximately 77,000 people were killed by resistant M. tuberculosis in the United States (Bright) and the medical cost to treat infections with antibiotic resistance has reached as high up to 44 billion dollars every year (Larsen). In the article of â€Å"Antibiotics Resistance† by Pushpa Larsen, roughly about 70 percent of those 2 million people in the United States who has beca me infected with diseases within a year were resistant to antibiotics that was being commonly treated in the hospitals (Larsen).With an overuse and misuse of antibiotics by the human population, it increases the chance of M. tuberculosis to evolve and have the ability to become resistant. Section 1 P2: (Words: 482) As people take antibiotics constantly and antibiotics that treats for a variety of M. tuberculosis, over a period of time it usually results in M. tuberculosis being resistant, and the only way to solve this is to change the human behavior. Since M. tuberculosis can reproduce rapidly within hours or days, the big population of the M. uberculosis causes the increase of adaptation to different environment (Bright). The ‘fast generation’ mentioned in the article of â€Å"Evolution of Antibiotic Resistance,† claimed that with such massive population, it also can rise the possibility of mutation in genes which causes variation (Bright). With having more cha nce of resulting variation among these huge quantity of population in M. tuberculosis, there will be more chance of these M. uberculosis with mutation to be selected for the environment due to natural selection. With M. tuberculosis being able to use specific tools gained from the gene, each can perform different methods of being resistance to the antibiotic’; for example, by taking ‘a gene from another bacterium’ (Bright). Scientists measure the percentage of M. Tuberculosis by using a special tool called, spectrophotometer to shoot out light and count the percentage of M. tuberculosis present in the tube. A certain amount of M.Tuberculosis will be added into the tube and place it inside the spectrophotometer to measure the percentage of population present in the tube by using a specific light of wave length with a scale pointing to how much light is being present (Ferguson, 2012). With having a higher population in the culture, the less light it will be shown i n the spectrophotometer (Ferguson, 2012). When antibiotics are added into the tube, those that are not resistant to the antibiotics are being killed, but those that are resistant survive (Ferguson, 2012).The measurement will show the amount of population being resistant to antibiotics by the scale shown in the spectrophotometer (Ferguson, 2012). There are no treatments to stop the M. tuberculosis from being resistant to antibiotics. However, we can help solve the problem of more bacteria being resistant to antibiotics by decreasing the amount use of antibiotics and taking antibiotics in the full cycle as prescribed by the doctor (Bright). The amount of antibiotics that people take is about 235 million doses a year, and approximately ‘one third to one half’ of the antibiotics being taken are not needed (Larsen).A research has found that patients have been demanding antibiotics from doctors even though the patient’s cold or other infections does not require any ant ibiotic use (Bright). The antibiotic misuse by people is that patients usually stop taking antibiotics once they feel that their cold or viral diseases is much better (Larsen). This can lead to the resistance in M. tuberculosis and ‘develop a stronger defense’(Larsen). By changing the human actions towards the use of antibiotics, it can help solve the problem of bacterium evolved in response to antibiotics.Section 2 P3 + P4 combine (Words: 407) The measurement of spectrophotometer to determine the percentage of M. Tuberculosis and the theory of natural selection both determines an effective way of observing how M. Tuberculosis evolved in response to antibiotics. By measuring the percentage of M. Tuberculosis present in a tube, the method of using spectrophotometer helps scientists to observe and witness the evolution of how M. Tuberculosis became more resistant to antibiotics overtime (Ferguson, 2012). The resistance of M. tuberculosis in ntibiotics due to evolution the ory of natural selection, those that favors in the natural selection tends to survive and reproduce to carry on their traits (Bright). As they reproduce, an immense volume of culture is being duplicated which increases more chance of variation among the tremendous population (Bright). Scientists uses tool like spectrophotometer to observe the rate of M. Tuberculosis being killed, and how those survived bacteria regained its immune towards antibiotics the next time it is being added to the culture (Ferguson, 2012).As each time an antibiotic is being added to the culture, those without resistance dies and those with, remain alive (Ferguson, 2012). Those that does live, increases and continues to grow (Ferguson, 2012). But, when an antibiotic is being added into the culture again in the next round, the rate of resistance of M. Tuberculosis increases in terms of building up a defense and using methods as in gaining a gene from a bacteria to become immune to antibiotics (Bright). Overtim e, the increase number of antibiotics added into the culture rapidly escalates and boost up the number of M.Tuberculosis being resistant (Ferguson, 2012). By looking at the theory of natural selection, those with best suited traits tends to be selected for, and reproduce in massive quantities which increases a greater possibility in variation. Either an antibiotic is being ameliorated from the former antibiotic or a completely recent developed antibiotic is invented, M. Tuberculosis will always find a solution to become more resistant to the antibiotic until it completely becomes unscathed to them (Bright). As more M. uberculosis gain further ability in building defense against the antibiotics, the more they reproduce those immune duplicates, the more difficult it will be for the human to fight against these M. Tuberculosis since they develop resistance. With the overpopulation of these cultures, the probability of variation is very high due to mutation in the gene (Bright). The met hod of measuring the increase in resistance helps benefits scientists to understand how M. Tuberculosis has evolve in response due to antibiotics and natural selection by using spectrophotometer.Section 3 P5 + P6 combine: (Words: 429) With the science application use of measurement of M. Tuberculosis percentage resistant to antibiotics and the theory of natural selection effects us socially in terms of causing chaos among the society with being unable to cure these M. Tuberculosis as they continue to become more resistant. Patients usually demands and gives pressure on doctors to provide them with antibiotics even when not needed (Bright). This usually is the reason to why M.Tuberculosis evolve and become resistant to antibiotics rapidly as more variation is present by the massive reproduction of M. Tuberculosis (Pitman, 2004). If the doctor suggests the patient to not take antibiotics, because it might cause the resistance towards antibiotics, then it is likely that patients will s till insist to take those antibiotics just to cure their infections or cold. Such aspect of the patient shows that they have no tolerance towards the future crisis of the uprising war between antibiotics and M. Tuberculosis.When a doctor insists their patients to take antibiotics as described in the instructions of the cycle, patients usually feel that their freedom of choice is being pressured and mostly they will go with their own opinion and decision making towards the use of antibiotics (Tekstiin, 2009). As patients sense that their cold or infectious disease has become better, they usually stop taking the antibiotics (Tekstiin, 2009). The reason for this is because some patients think that their immune system have the ability to fight against the bacteria present in their body.Research have found that taking antibiotics are very detrimental to the body in terms of damaging the good bacteria, as well as decreasing the competition between the harmful bacteria and the beneficial b acteria existing in your body (Tekstiin, 2009). In the future when people are infected by infectious diseases, the infection in the human body will not be effected by the antibiotics since they have evolved resistance towards antibiotics (Tekstiin, 2009).With this reason, as more people get infected with diseases, the antibiotics will be ineffective and cause turmoil among the society because doctors will be unable to cure them since the resistance in M. tuberculosis continues to rise rapidly. As a large percentage of the people becomes infected with diseases that are unable to be treated, the world could lose a massive population because more and more people are infected by the disease each day. The science application of measurement on resistance in M. Tuberculosis and the natural selection links to the factor socially with the cause of ineffectiveness of most antibiotics towards M.Tuberculosis, causing a huge loss in human population. Tuberculosis by looking at the curve of the increasing resistance in antibiotics as the natural selection provides the chance of stronger resistance due to variation of M. Tuberculosis; and with this, scientists are able to predict that it will effect the society economically in terms of medical costs to treat resistance in antibiotics. With people constantly overusing antibiotics for treating their infections or cold; overtime, those M.Tuberculosis that survived recovers by reproducing a large quantity of population and develop a defense against the antibiotics (â€Å"Antibiotic resistance,† 2008). As more antibiotics are given and added to kill the M. Tuberculosis, they become more resistant each time and soon, they will become completely resistant to antibiotics within a short period of time. As the number of resistant M. Tuberculosis increases, the more time and money scientists will have to invest on research and create anti biotics to treat the infected growing human population.With the experimentation, tools and a variety solutions of antibiotics, it all comes with a large amount of money. The healthcare system might find themselves drowning and finding difficulty in finance since a large amount of money will be spent on medical research and care (â€Å"Study on the,† 2009). Also, they will find trouble in restoring their stability in health care for the people when several people are dying since no treatment can be cured (â€Å"Study on the,† 2009). However, it is not only the scientists and the healthcare association who suffers, but also the infected patient’s families as well.To treat such infection with resistance towards antibiotics it comes to a huge cost in finance for the patient’s family (â€Å"Study on the,† 2009). A bit more into the play Helena expresses her confusion and betrayal towards Demetrius. â€Å"For ere Demetrius looked on Hermia’s eyne, / He hail’d down oaths that he was only mine. / And when this hail some heat from Hermia felt,/ So he dissolv’d, and showers of oaths did melt. In this metaphor Helena is saying that Demetrius had made so many promises to her like balls of ice (hail stones) but when Hermia came along he made broke them causing Demetrius’s promises to have melted. We feel sympathetic towards Hermia as Demetrius led Helena on, making all of these promises when only later he would break all of them. Desperation is shown when Helena tells Demetrius about Hermia and Lysander’s plan to run away, betraying Hermia in the process. She is so desperate that she betrayed her best friend, Hermia. It was a bit hypocritical of her to betray Hermia and endangering their friendship like that when later on she accuses Hermia of throwing away their friendship when actually Hermia was stating the truth. â€Å"But herein mean I enrich my pain, / To have his slight thither, and back again. † In this quote it shows that Helena has come to the conclusion that Demetrius would never love her. So she would betray her best friend to just be pleased with by Demetrius but this doesn’t seem the case when you read later on in the play that Demetrius gets even more irritated with Helena. Helena is basically saying that even though it would pain her to see Demetrius chasing after Hermia she would still do it. At this moment the audience would’ve felt annoyed and sympathetic. The audience annoyed at Helena because she had ruined her best friend’s plan just to help her in her love life. This would be considered as selfish. However we would be sympathetic towards her as she has completely given up on being loved by Demetrius. However when her wishes are finally granted she doesn’t believe it creating a huge argument: â€Å"Wherefore was I to this keen mockery born? When at your hands did I deserve this scorn? † At this point Helena lets out all the insecurities, anger and sadness she’s ever been feeling. Her life for the last couple of months has been an emotional rollercoaster. â€Å"Is’t not enough, is’t enough, young man, / That I did never, no, nor never can/ Deserve a sweet look from Demetrius’ eye/ But you mu st flout my insufficiency? † The repetition that she uses suggests that she is so angry at Demetrius that she repeats her words; she’s so angry that she cannot think straight. The whole reason she’s angry is that she thinks that they are mocking her as Helena cannot believe anyone could possibly love her as she is so used to being rejected. If Demetrius couldn’t love her, who would? Her low self esteem also appears into her passage and her words. Helena feels confused at how anyone could ever like her and most of all outraged that her friends would mock and make fun of her. The audience feel humoured at this situation as Helena is claiming that Lysander and Demetrius don’t love her when actually they are in love with her to the point of madness. We also feel sorry towards her as she sees herself as a reject. At the end, when the confusion is solved and Helena finally has Demetrius she says some final words. â€Å"So methinks; / And I have found Demetrius, like a jewel, / Mine own, and not mine own. † In this metaphor she compares Demetrius to a jewel like she had been digging for a diamond and had finally found it. It shows how much Helena values Demetrius. At this point she finally realises that Demetrius actually does love her. At this point the udience would be feeling happy for Helena as she’s finally cheerful. However they might think that Demetrius doesn’t actually deserve Helena. In conclusion, Helena is showed as a heartbroken and desperate girl at the beginning then at the end she seems happy. The audience experience a range of emotions towards her, including sympathy, irritation and happiness. At the end of the play, we are likely to feel happy and satisfied because she finally has what she wan ts. Also throughout the whole play she is always depressed, sad or scolding herself.

We can find the roots of conflicts from human nature. I believe that the human nature is a complex combination including both Hobbes human nature theory and Hegels master and slave theory. Before the industrial revolution, people needed months or years to travel cross the continents or oceans. Geographic barriers greatly reduce the incentive of waging war to a faraway nation. The conflicts of gain, safety and reputation were greatly weakened by geographic distance. For example, no nation wanted to wage war from North America to the Middle East thousands of years ago. In fact, lots of nations were sort of isolated from the other nations. Thus, in the ancient time, there had no war of every nation against every nation. However, nowadays technology has made the geographic barrier almost be vanished. Information transfers within the world in a few seconds. People can travel to anywhere in a couple of days. The world becomes a small village. In this small village, every nation is competing with others for gain, safety, and reputations. With the natural conflicts between nations and the deadly power of nuclear weapons, sooner or later, the world will be inevitably in a war of every nation against every nation, and in such a war, the life will be solitary, poor, nasty, brutish and short. Only a world government with dominant military power can prevent such horrible condition. The world government can use its great coercive power to maintenance the peace between nations. If there is a war between nations or a civil war inside a nation, the world government can step in by its powerful army to stop the war. In terms of Hobbes first natural law, man is to seek peace, and follow it (Hobbes 33). Here, nations also apply to the first natural law, which is that all nations seek peace, so they follow the global government. The global government uses its coercive military power to stop war, but it cannot fully prevent war. For example, when two nations have conflicts, and fight in a war, the world government can only send its powerful army to stop the war after the war has begun. On the other hand, the world government may have to use war to stop the war. For example, if one nation invades another nation, the world government may have to attack the invader to force it to retreat from the victim country. So the war still exists. Under this condition, non-violent resistance is the only way to prevent the war. Non-violent resistance is associated with Hegels view of human nature. Hegel believes that human nature is the drive of gaining recognitions from others. To gain recognition, individual must struggle to have superior power than others. Therefore, individual can have freedom as a master to force others to be slaves. The slaves have to work for the masters, and be surviving by the exchange of acknowledging the masters identity (Hegel 36). According to Hegels theory of human nature, the conflicts between human beings are not necessary to lead to war or violence. In other words, war is not inevitable. Since the human nature is to seek for recognition from others, if other individuals are killed by war or violence, the recognition by the other individual can not exist. So, human beings do not naturally have incentive to use violence or war to solve conflicts. Human beings, however, must want to only threaten others with death for recognition. The threat will never be credible, because the death of the slavers will make the master be meaningless. A master can not be a master if there are no slavers at all. Therefore, non-violent resistance makes sense in dealing with conflicts in the world. For example, suppose there is a very small community with only two men inside. In terms of Hegels Chen 4 human nature theory, both of the two men will struggle for recognition of being the master. The natural drive will cause conflicts between the two men. To solve the conflict, the stronger man will make a death threat to the weaker man. However, the stronger man actually will never kill the weaker man if the weaker man does not use violence against the stronger man, because the stronger man desires the recognition from the weaker man. So the weaker man does not need to fear the death threat. At the same time, the weaker man can not use violence to fight with the stronger man, because the weaker man will definitely be killed during the violent fight. Therefore, the weaker man can deal with the conflicts by non-violent resistance. Firstly, he knows that a violent fight will certainly cause his death. Secondly, he knows that non-violent resistance will never cause his death. By non-violent resistance, the weaker man does not obey the stronger mans order and he does not cooperate with the stronger man. Eventually, the stronger man cannot be a true master, and the weaker man will not be a true slave. Non-violent resistance can be used between communities and nations as well. In the global community, nations have natural desire to be acknowledged to be the dominant nation. For example, during the cold war era, both the Soviet Union and the United States wanted to dominate the world. With much greater military power, the two superpowers have invaded some weaker countries. If all the weaker countries have used non-violent resistance strategy, the war could be prevented. Meanwhile, since the weaker countries do not cooperate with the invader, the weaker countries would never be truly occupied. I am arguing that non-violent resistance can prevent war or violence, but I do not mean that non-violent resistance can always prevent war or violence. The assumption of using the non-violent resistance strategy is that the two individuals or nations in conflicts have very distinct Chen 5 power difference. If the two nations have similar power, nobody can know which nation is undoubtedly more powerful. Thus, while having conflicts, the two similar powerful nations have to fight each other to find out who is really more powerful. As a result, there will have a war before the non-violent resistance to prevent wars. Thus, both federalism and non-violent resistance are necessary to achieve a completely peaceful world. The global government must have superior military power to deal with conflicts between nations. Inside individual nations, the national government must have dominant military power to deal with conflicts between different communities of the nation. While facing conflicts, all the weaker sides, for example, a community which has conflicts with the national government, or a nation which has conflicts with the global government, must deal with the conflicts by either negotiation or non-violent resistance instead of war or violence. Finally, the completely peaceful world will be achieved. Both Federalism and non-violent resistance are necessary because I believe that human nature is a complex combination of both Hobbes and Hegels theory. Human beings have the first natural desire for safety. The second natural desires are gain, glory and recognition. Without life, all the gain, glory and recognition are meaningless. So safety must be the first natural desire. When security is guaranteed, human beings will turn to pursue gain, glory and recognition. In theory, I argue that Federalism and non-violent resistance can completely eliminate war. In the real world, however, there are some challenges to realize Federalism and non-violent resistance. For instance, many people have Hobbesian syndrome. They buy into Hobbes human nature theory, but they do not agree with Hegels theory. Thus, they believe that war is inevitable without a powerful global government. However, there is no powerful global government now, so Chen 6 the people who have Hobbesian syndrome always suggest investing heavily on military resources to prepare for the future inevitable war. If a superpower holds this view, it is very difficult to establish a global government with dominant military power. For example, today the only superpower, the United States, has nearly half of the whole world military spending annually. If the United States does not disarm, it is very difficult to set up a global government which has greater military power than the United States. It is a circle, without a powerful global government, the United States believes that it must engage great military resources. When the superpower United States engage great military resources, it is very difficult to set up a global government with a more powerful military. Another challenge comes from the non-violent strategy. When facing conflicts, sometimes it is ambiguous to know whether the conflicts come from the desire for safety, gain, glory or recognition. If the conflicts come from recognition, the non-violent resistance strategy will be very effective to prevent war or violence. However, if the conflicts come from safety, gain and glory, using non-violent resistance might just simply like suicide. In history, there were lots of evidences of genocide incidents. For example, in the World War II, Nazi tried to kill all the Jews. So it is difficult to persuade everybody to always behave non-violent resistance while having conflicts with much more powerful competitors. In sum, human nature is the natural desires of safety, gain, glory and recognition. To fulfill the natural desires, conflicts between individuals or nations will emerge. The conflicts are the very root of wars. A powerful world government and universally accepted non-violent resistance strategy can terminate wars in the world. For a valid contract, the basic elements that need to exist are: Agreement (comprising offer and acceptance): The existence of an offer and an acceptance are a means of analyzing the process of negotiation to decide whether a contract has been made and if so, when it was made. Mutual assent of the parties is the basic of an agreement. Consideration: This is the value given by the parties for the promise that is being made. Usually consideration takes the form of money, property and services. Capacity: Only parties who have capacity are able to enter the intro a valid and enforceable contract. An offer is referred to in s 2(a) of CA 1950 as a proposal which is made when one person signifies to another his willingness to do or abstain from doing anything, with a view to obtaining the assent of that other to such act or abstinence. Acceptance, for a contract to be valid, there must be a proper acceptance by the offeree. Section 2(b) of CA 1950 provides that when by offeree signifies his assent to the offer, the offer is said to be accepted. Rules of a valid acceptance, if the acceptance of any promise is made in words, the promise is said to be express, and if the acceptance is made other than in words, the promise is said to be implied: s 9, CA 1950. Intention to create legal relations, an agreement reached between an offeror and an offeree will be a legally binding contract only if the parties intended that they should be legally bound. The parties intention to be bound can be specifically stated or be implied from their actions. Where intention is expressly stated, the courts would not impure otherwise unless there is strong evidence to prove the contrary. In social and domestic agreements between family and friends, there is a presumption that these agreements are not meant to be legally binding unless the contrary can be proven. In Balfour v Balfour (1919), the husband went to work in Ceylon and agreed to pay his wife 30 per month. He didnt pay the money and the wife sued. It was held that there was no contract because the parties didnt intend to create a legal relationship. In business and commercial agreements, which are more formal in nature; there is presumption that there is intention to create legal relations. Capacity to contract, in order to have a valid contract all parties to a contract must have capacity to enter into a contract. Capacity refers to the legal ability to go through into a contract and the law generally assumes that everyone has capacity to contract except certain categories of persons. Section 11 of CA 1950 presents that every person is competent to contract who are of the age of majority according to the law to which he is subject, of sound mind and not disqualified from contracting by any law to which he is subject. Certainty, agreements that are not certain in meaning or which the meaning is not capable of being made certain are void; s 30, CA 1950. The terms of an agreement ought to obvious, precise and certain. It cannot be vague. An agreement which is ambiguous and uncertain is not capable of being accepted as a valid contract. When one party to a contract has refused to perform, or disabled himself from performing his promise in its entirety, the promisee may put an end to the contract, unless he has signified, by words or conduct, his acquiescence in its continuance; s 40, CA 1950. Injunction, an injunction is an order of the court restraining a person from doing a specific act in the future. It is granted only when it is just and equitable to do so having regard to all the circumstances of the case. Specific relief Act 1950, section 50 of Specific Relief Act 1950 provides that it is a preventive relief granted at the discretion of the courts. In respect of contracts, an injunction may be sought to prevent a party from committing a breach of contract. For example, the court may order that a seller be restrained from selling land to anyone else when the seller has contracted to sell that land to the plaintiff. A court may award damages to an injured party either in addition to, or in substitution for, an order of injunction. Quantum meruit, quantum meruit determines the amount to be paid for services, when no contract exists (a doctor giving emergency aid), or where the parties to a contract have failed to agree on a price, and so on. If there is an existing contract for a stipulated amount and the mode of compensation for services, the plaintiff cannot abandon the contract and resort to an action for quantum meruit. For example, if a person sues for payment for services in such circumstances, the court will calculate the amount due based on time and usual rate of pay or the customary charge, based on quantum meruit by implying a contract existed. Before proposing a reform to the American criminal justice system, we must first examine the problems that plague the process of justice on all levels. American society plays an important role in shaping the criminal justice system. Their beliefs and values determine the type of deviants and the consequences of the crimes. Often their beliefs contradict each other. Americans believe that the more serious a crime is, the longer a person should spend in a prison. In reality it means that a law at discretion can sometimes just set a number of years that a person should spend in the jail, regardless of the situation. The time in the prison is often very long (Randall, Brown, Miller& Fritzler, p.216) because some states have definite sentence or mandatory sentences which leave little room for the judge to decide on the merits of the person. For example, California favors â€Å"Three Strikes and You’re Out†(Randall & et al., p.216) stance on the laws which means after third felony crime, a person must spend 25-year-to-life sentence in the prison. They believe that the deprivations of basic needs, isolation from the society, and in extreme cases, death are consequences of committing a crime. The process of the court in America values efficiency and tough punishments. Since there are a lot of arrests, the court is overburdened and pressed for time. The prisoners are processed through like animals for the slaughter, quickly and with no mercy. The inequality in the terms of power and money influences the court. People with deep pockets are able to bail out or negotiate for a lesser term than a person assigned to a free lawyer by the state. Those consequences Americans believe will serve as deterrence or warning to people to obey the law... ...not the answer to all of the problems that America is experiencing in the criminal justice system, but however it may take the pressure off the state to provide the help to people. Julius Caesar has always been an important, well-known figure in history. His name still lives on, two thousand years after his death. Even the terms "Kaiser" and "Tsar" are renditions of "Caesar." To this day, the name "Caesar" conjures images of ancient Rome, conspiracies, intrigue, and murder. Thanks to William Shakespeare, most people know that he was betrayed and killed by his friends. But what made Caesar so fascinating that Shakespeare would choose to write about Caesar over fifteen hundred years after his death? Why do we remember Caesar? He was a great military leader, and a master politician. He was murdered. But there have been others in history like Caesar, yet we do not remember their names. We remember Caesar because the common Romans adored him. Caesar was able to empathize with them, and they loved him, even to the point of elevating him to the status of a god. It is because of the people that he led that we remember Caesar's name. Gaius Julius Caesar was born in 100 B.C. to Aurelia and Julius Caesar, in the neighborhood of Subura, just a short distance from the heart of Rome. Although the Caesars were patrician nobility, much of the family's money had run out by the time that Caesar was born. It was for this reason that Aurelia and Julius lived in the less prosperous Subura area. Because he was raised in this area, the young Caesar had a unique perspective. He was "A patrician descendant of kings who knew intimately the lives and sorrows of common Romans" (Freeman 19). Therefore, when he became an adult, he was able to identify with the less-affluent plebeian class better than most Romans in politics at the time. As with most Roman families, the elder Caesar was often away from ... ...ed? True, he was a great military leader, and a great leader of men. Yet that is only a part of why he has been remembered. There have been other great leaders that have not been as remembered throughout history as Caesar has. We remember him because the people whom he governed immortalized him throughout history.
